This article examines the legal and illegal use of trademarks in the context of globalization and the digital economy. It evaluates the impact of the strict formalism of registration systems on the vulnerability of real businesses to non-practicing entities. It is established that traditional protection methods demonstrate low effectiveness against algorithmic cybersquatting and brand trolling. Patterns of judicial practice and international mechanisms for countering squatting are characterized using the examples of the United Kingdom, the European Union, the United States, and China. The findings show that overcoming the crisis requires the introduction of preventive administrative filters, legal recognition of a perpetual right to annul squatters’ assets, and the assignment of strict tort liability to AI operators.
