This article is directly devoted to the implementation of new provisions in the current criminal procedural legislation, which provide for the strengthening of the guarantees of individual rights and freedoms at the stage before the trial, determining the status of the person at at the pre-investigation stage. The article also examines the need to define the procedural status, rights, and obligations of a person subject to a pre-investigation inquiry under the Criminal Procedure Code. The existing problems in sending the application (message) about the crime to the competent authority were analyzed. In the practice of law enforcement, the need to obtain permission to conduct certain investigative actions that are prohibited by law when considering a complaint (report) about a crime, as well as the decisions taken by officials who have the appropriate authority to review the report (report) (initiation of a criminal case, During the study of the legality of the decision to refuse to initiate a case, proposals were developed regarding the procedure for appropriate response to the illegal, unreasonable and unjust decisions, and recommendations were developed regarding their inclusion in some norms of the Criminal Procedure Code of the Republic of Uzbekistan in the future.
