The article provides a comparative legal analysis of the use of electronic data in criminal proceedings, taking into account international standards, as well as the experience of the United States, Canada, the European Union, and selected states belonging to the continental legal family. It is substantiated that electronic data are gradually transforming from an auxiliary source of factual information into an independent object of criminal procedural regulation. Particular attention is paid to issues of admissibility, relevance, reliability, preservation, cross-border access, judicial control, and the balance between the effectiveness of investigation and the protection of individual rights. The article concludes that it is necessary to develop a specialized procedural model for working with electronic data, including urgent preservation, digital forensic recording, documentation of the chain of custody, judicial authorization of access, and international cooperation with digital service providers.
