This article systematically examines current issues in the legal regulation of the e-commerce sector in the context of the rapid development of the digital economy, in particular the effectiveness of administrative and legal measures in ensuring the rule of law. The study conducted a comparative analysis of the history of the emergence of e-commerce, the international UNCITRAL Model Laws, and the stages in the formation and development of national legislation. As a result of the analysis, it became clear that the current legislation does not sufficiently define the liability of operators of electronic trading platforms (marketplaces) or specific administrative sanctions in cases of discrimination against business entities. The study also considered international experience in protecting intellectual property rights, using the example of the “Christian Louboutin” case, and determined the legal significance of brand identification in the digital market. The problems associated with contractual inequality between e-commerce participants and the abuse of the dominant position by large platforms were examined in detail. As a result of the research, scientifically substantiated proposals were developed to include a new article in the Code of Administrative Responsibility providing for specific liability for specific violations in the field of e-commerce, in order to fill legal gaps in this area. It was concluded that the implementation of these proposals will serve to strengthen the rule of law in the electronic market and reliably guarantee the rights of entrepreneurs and consumers.
