The article is devoted to a historical and legal analysis of the formation and development of the institution of human rights protection in a constitutional state. It examines the interpretation of the concept of “constitution” across different historical periods, including Ancient Rome and the modern era. Key legal acts and doctrines that have influenced modern constitutionalism are analyzed. The study highlights the interrelation between human rights and the limitation of state power.
