Environmental Disputes and the Public Interest: The Limits of Mediation and the “Environmental Cooperation/Facilitation” Model for the Republic of Uzbekistan in Relation to EIA/SEA and Environmental Control

Environmental conflicts in the public sphere are structurally distinct from “private-law” disputes: they affect an indeterminate circle of persons, distribute risks among communities, and almost always rely on administrative decisions. In Uzbekistan, this distinction is reflected in the legal “boundary” of mediation: the Law “On Mediation” excludes disputes affecting the rights of third parties and public interests, while the strict confidentiality regime is poorly compatible with the transparency requirements of environmental procedures. Since 2025, the legislative architecture of environmental assessment, including environmental impact assessment (EIA) and strategic environmental assessment (SEA), has strengthened the “public-procedural core”: public hearings are introduced prior to state environmental expertise, and the results of such hearings are published on official websites. The article substantiates a model of eco-facilitation as a procedural “bridge” between the legal limitations of mediation and the requirements of public environmental processes in Uzbekistan.
