This article analyzes the current legal mechanism for declaring individuals insolvent in the Republic of Uzbekistan and substantiates the need for its further development through the introduction of a simplified (out-of-court) procedure. It is noted that the implementation of personal insolvency proceedings is currently carried out exclusively through the court system, which limits access to legal rehabilitation for socially vulnerable categories of debtors and is accompanied by significant transaction costs. The article argues that the judicial model does not fully align with the objectives of effective law enforcement and the "second chance" principle. The expediency of introducing an administrative mechanism for declaring insolvent those individuals who do not possess assets and have limited liabilities is substantiated. Proposals are formulated to improve legislation aimed at enhancing the effectiveness of the personal insolvency institution.
