The article examines international educational migration as a complex socio-legal phenomenon that has gained strategic importance in the context of globalization and the internationalization of education. It analyzes the main academic approaches to defining and classifying educational migration, including its relationship with intellectual migration and the phenomenon of “brain drain.” The study identifies key internal and external factors influencing students’ choice of destination countries, such as the quality of education, universities’ academic reputation, migration policies, financial conditions, and graduates’ employment prospects. Special attention is paid to current global trends in educational mobility and to the position of the Republic of Uzbekistan within international migration flows. Drawing on statistical data, the article demonstrates a steady increase in the number of Uzbek students studying abroad, as well as significant growth in the inflow of foreign students to national higher education institutions. Recent changes in the geographical orientation of educational migration are also analyzed. The legal foundations of state youth and education policy in Uzbekistan are examined, including constitutional guarantees and key strategic policy documents. The article concludes by identifying systemic legal and institutional challenges in regulating international educational migration and substantiating the need for a comprehensive and forward-looking governance framework to enhance its contribution to sustainable national development.
