Annotatsiya

This article analyzes the legal nature of rape, its theoretical foundations, the elements of the offence, and problems in current legislation. It reviews scientific literature and doctrinal works concerning the offences set out in Article 118 of the Criminal Code of the Republic of Uzbekistan and addresses contradictions and controversial issues in the criminal-law theory, judicial practice, and investigative practice that affect the qualification of this crime. The study examines specific issues related to the use of violence, intimidation, and threats, as well as the commission of sexual violence by exploiting the victim’s helplessness, and it analyzes features of the corpus delicti. It also considers problems in determining whether a person’s actions constitute a completed offence or only the signs of an attempted offence, the differences between rape and attempted rape, and the legal status of voluntary withdrawal or renunciation by a perpetrator.
