The article analyzes the legal construction of Article 98 of the Constitution of the Republic of Uzbekistan, which provides the Constitutional Court, the Supreme Court, and the Prosecutor General of the Republic of Uzbekistan with the right of legislative initiative on issues within their jurisdiction. Narrow and broad approaches to the legal understanding of the phrase “issues of jurisdiction” are considered. According to the authors, the right of legislative initiative could be defined as a state-guaranteed, equal opportunity for all subjects of the right of legislative initiative to, in the prescribed manner, freely submit to the legislative body draft laws that are subject to mandatory consideration at a meeting of the legislative body. The need to clarify the term “the right of legislative initiative of the Constitutional Court and the Supreme Court and the Prosecutor General of the Republic of Uzbekistan on issues of their jurisdiction” is emphasized. The thesis that the implementation of the right of legislative initiative will put the Constitutional Court of the Republic of Uzbekistan in the position of a judge in its case is refuted. The following arguments are given: the implementation of this right does not at all guarantee the adoption of a law with the original textual content of the bill. In most cases, the body of constitutional control does not establish textual flaws in the law under review, but rather its content, taking into account law enforcement practice.
