Annotatsiya

This article examines the origins of legal advocacy through the function it performs in mediating between individuals and the law. Drawing on the works of Livy, Pomponius, Gaius, Cicero, and Dionysius of Halicarnassus, the study analyzes the Twelve Tables, the pontiffs’ monopoly over legal knowledge, and the subsequent erosion of that monopoly. It compares four theoretical approaches to the origins of the legal profession: the theories of Grellet-Dumazeau and E. V. Vaskovsky, the institutional theory, and the functional theory. The analysis demonstrates that the publication and accessibility of legal rules do not, by themselves, eliminate the knowledge gap, or information asymmetry, between the law and the individual; rather, they shift this asymmetry from knowledge of the legal text to knowledge of its interpretation and the procedures required for its application. On this basis, the article argues that the original and enduring function of legal advocacy is an intermediary, or bridging, function connecting individuals with the law. This argument is further examined through comparative reference to the Code of Hammurabi, the rules of legal agency in al-Marghinani’s al-Hidaya, and the practice of qadi courts in Turkestan. Finally, the study relates this functional understanding of legal advocacy to the economic concept of credence goods, providing an interdisciplinary explanation for the continuing need for professional legal intermediaries even where legal rules are formally accessible to the public.
