This article develops an adaptive model of lawmaking policy encompassing the entire life cycle of a regulatory decision. Drawing on doctrinal and comparative legal analysis, the study examines the legislation of Uzbekistan in conjunction with OECD and European Union approaches to regulatory governance. It proposes a strategic filter designed to diagnose the underlying problem, determine whether legal intervention is necessary, compare legal and non-legal alternatives, and define expected outcomes before the drafting process begins. The article demonstrates how directly applicable legislation, constraints on delegated rulemaking, regulatory experimentation, outcome-oriented rules, monitoring, and ex post evaluation can be integrated within a single decision-making cycle. The resulting model comprises seven stages: diagnosis, strategic filtering, regulatory design, experimentation where warranted by uncertainty, implementation and monitoring, ex post evaluation, and adaptation. The effectiveness of lawmaking policy is assessed by the extent to which the underlying regulatory problem is resolved rather than by the number of legal instruments adopted. The study concludes that regulatory flexibility should be accompanied by clearly defined legal boundaries, measurable outcomes, accountability mechanisms, and timely review.
