Annotatsiya

The purpose of this study is to substantiate a comprehensive legislative model for countering the creation and administration of trading platforms operating within hidden segments of the Internet (DarkNet) that are knowingly intended for the systematic commission of crimes or the facilitation thereof. The study employs formal legal, comparative legal, and systemic-structural methods. It has been established that the current legislation of the Republic of Uzbekistan regulates the handling of electronic data and digital evidence, provides for liability for certain offences in the field of information technologies and violations related to the circulation of crypto-assets, but does not specifically distinguish the management of criminal digital trading infrastructure as an independent subject of criminal-law assessment. The article examines the model proposed by the author, which includes a criminal-law provision establishing clear criteria for knowingly criminal purposes and actual control over the platform, special requirements for the recording and preservation of electronic data during the inspection of Internet resources, a mechanism for the expedited preservation of data within the framework of international cooperation, and scientific and technological support for digital forensics.
