A Scientific and Theoretical Analysis of Civil Liability Frameworks Under Construction Contracts in Developed Countries

Annotatsiya

The article compares the models of civil liability for breach of construction contracts in developed jurisdictions. It demonstrates that the general concept encompasses mechanisms of different legal nature: fault-based contractual liability, strict warranty liability for serious defects, and tort liability to third parties. The study examines the system of remedies under §§ 633–635 of the BGB, the French garantie décennale (Article 1792 of the Code civil), the proportionality test developed in English law following the Ruxley case and the Building Safety Act 2022, as well as the U.S. Spearin doctrine. It concludes that Articles 681–682 of the Civil Code of the Republic of Uzbekistan provide a strong legal foundation for a long-term warranty but lack the mechanisms necessary to make it effective in practice; specific amendments are proposed.
