This article analyzes the theoretical and practical significance of the phenomenon of “discretion” in law enforcement practice. It substantiates that the inconsistency between the abstract nature of legislation and the dynamics of social relations creates an inevitable need for discretion. The article conceptually distinguishes between “freedom of choice,” “discretionary power,” “discretion,” and “arbitrariness,” illustrating their hierarchical mechanism of operation in practice through the example of public administration at the central, regional, and lower executive levels. It also highlights the risks of applying the law disproportionately to its intended purpose, which may lead to arbitrariness. Furthermore, the study specifically emphasizes the emergence of “digital discretion” as a new evolutionary form of discretion in the context of current digital transformation and its relevance in public administration. It is emphasized that making a discretionary decision is not merely a matter of freedom of choice, but a significant responsibility that serves the spirit of the law, social objectives, and the principle of justice, once again pointing to the risks of misapplying the law and bureaucratic arbitrariness. In modern governance, “digital discretion” should serve only as a supplementary tool to traditional methods. While standard services may be automated, it is crucial that the final decision be made by a human in order to ensure justice in complex cases involving human rights.
