The article substantiates constructive secularism as a legal criterion for balancing freedom of conscience, equality of religious associations, institutional neutrality of the state and protection of public order. The scientific novelty lies in proposing a four-element test for assessing state action in the religious sphere: legitimate aim, confessional neutrality, necessity and proportionality, and non-discriminatory effects for believers, non-believers and religious organizations. Relying on Uzbek legislation, official 2024 data, international standards and comparative case law of the European Court of Human Rights, the article argues that secularism should be understood not as exclusion of religion from public life, but as a guarantee-regulatory regime that permits lawful cooperation while preventing confessionalization of public authority.
