This article analyzes the current legal mechanisms for preserving the right of temporarily absent citizens to use residential premises within the state housing fund of the Republic of Uzbekistan. In particular, the six-month period established in Article 52 of the Housing Code of the Republic of Uzbekistan is critically assessed in light of modern migration processes. In the course of the study, three main models for regulating this institution—imperative, criterion-based, and dispositive approaches—are identified on the basis of international experience, and a comparative legal analysis is conducted with the legislation of the United Kingdom, France, Russia, and other countries. Furthermore, the article identifies gaps in the existing regulatory framework for ensuring citizens’ housing rights under contemporary conditions of labor migration. The paper concludes with scientifically substantiated and practical proposals aimed at improving national legislation, emphasizing the need to make the mechanism for preserving housing rights more flexible and aligned with the principles of social justice.
