The article examines the legality of parallel imports from the perspective of the rights holder, considering the nature of exclusive rights and the doctrine of exhaustion of rights as enshrined in legislation. The analysis explores the limits of the exclusive right to a trademark and substantiates that the legal assessment of parallel imports is not universal, but rather depends on the chosen exhaustion of rights model (national, regional, or international). The article concludes that, from the rights holder's viewpoint, parallel imports may be deemed either permissible or an infringement depending on the legal regime. Furthermore, even where parallel imports are legalized, mechanisms to protect the rights holder's interests remain in place.
