This article explores various aspects of procedural regulation and implementation of the defense function in criminal proceedings. Descriptive and comparative research methods are employed, along with analysis of legislative documents, legal literature, and scholars' opinions. The main question motivating the study concerns the right to defense in criminal proceedings as outlined in legal documents. It emphasizes that ensuring the right to defense for suspects, defendants, and accused individuals, alongside their procedural rights and obligations, is a key aspect of the work of investigators, prosecutors, and the court aimed at guaranteeing the realization of these rights. Providing this right means that suspects, defendants, and accused individuals are considered to possess all necessary procedural rights enabling them to defend themselves either independently or with the assistance of a defense counsel. The concluding part of the article offers scientific and theoretical recommendations for improving the protection of the right to defense in criminal proceedings, as well as considerations for enhancing practice.
