This article provides an in-depth theoretical and legal analysis of crimes committed by military personnel, examining the intersection of military law and criminal justice. The article begins by describing the structure of military justice systems, focusing on the specific legal standards and procedural rules applicable to military personnel as compared to civilians. The study includes an analysis of various categories of military offenses, such as insubordination, desertion, and misbehavior, and also examines conventional crimes, including violent acts and property crimes, committed in a military environment. Using comparative law methodology, the authors examine different jurisdictions' approaches to war crimes, highlighting the balance between maintaining discipline and ensuring justice. Theoretical perspectives from the fields of criminology and military ethics are integrated to understand the motivation for war crimes and the effectiveness of current legal frameworks in preventing such behavior. The article concludes by assessing the implications of current military legal practices and offering recommendations for reforming them to improve accountability and fairness among military officials. This study contributes to the debate on the law of war by providing useful information for policymakers, military officers, and scholars interested in studying the relationship between law, military operations, and crime.
