The article examines the protection of a deceased person’s digital data through the interrelationship between inheritance law, personal non-property rights, intellectual property, and contractual relationships with platforms. It systematizes approaches developed in legal scholarship that are grounded in property rights, copyright, and privacy. The article argues against treating all digital data as part of the deceased’s estate and establishes the distinction between the authority to access data and the right to dispose of it.
