The article advances the thesis that the content rights holder constitutes the structural third party to the cyberspace content-distribution contract, on a par with the platform operator and the end consumer. Drawing upon the WIPO Copyright Treaty, EU Directives 2019/770 and 2019/790, the German Urheberrechtsgesetz and the French droit dʼauteur tradition, the study identifies a three-layered system of obligations binding the rights holder and proposes a draft article for incorporation into the Civil Code of the Republic of Uzbekistan. The novelty of the contribution lies in the doctrinal recognition of indirect contractual liability of the rights holder vis-à-vis the consumer, mediated through the platform operator.
