This article provides a comprehensive theoretical, legal, and dogmatic analysis of the problems of tort liability for harm caused by the functioning of autonomous agents, including artificial intelligence systems, robotics, and unmanned vehicles. Special attention is paid to the specific features of compensation for harm under experimental legal regimes, or “regulatory sandboxes,” which are being actively implemented in the Republic of Uzbekistan as part of the digital transformation of the economy. The author explores the limits of applying general tort provisions and the concept of a source of increased danger, as provided by the Civil Code of the Republic of Uzbekistan, to the actions of self-learning algorithms. Fundamental contradictions between the traditional principle of fault and the emergent properties of artificial intelligence, including the “black box” problem, are revealed. Based on advanced doctrinal approaches, specific models of risk distribution in regulatory sandboxes are proposed: channeling objective, or strict, liability to the operator of the experimental legal regime and introducing mechanisms of compulsory civil liability insurance. Proposals are formulated for modernizing the civil legislation of the Republic of Uzbekistan in order to ensure a fair balance between stimulating innovation and protecting the rights of victims.
