It was found that the principal legal mechanisms of the European Union against criminal activity in the crypto-asset sector are the MiCA Regulation (Regulation (EU) 2023/1114) and the operations of Europol’s European Cybercrime Centre (EC3). It was established that these two mechanisms, combining preventive and reactive approaches, constitute the EU’s integrated legal system in this domain. The impact of MiCA’s Title VI market abuse provisions, mandatory CASP licensing, and the Transfer of Funds Regulation (Travel Rule) was evaluated. Trends in ransomware, investment fraud, and money-laundering were characterized on the basis of the Europol IOCTA 2024 report. The limitations of the existing system with respect to DeFi protocols and AI-enabled criminal schemes were also considered. The findings have direct implications for jurisdictions such as Uzbekistan that are developing their own digital asset regulatory frameworks.
