This article examines the main challenges faced by the international community in attempting to apply existing legal norms for environmental protection during armed conflicts. The author analyzes systemic barriers such as the excessively high threshold for proving environmental damage established in key instruments of international humanitarian law, the terminological ambiguity of fundamental concepts, the limited scope of application of existing treaties with regard to the parties involved, and the difficulties in establishing a causal link between military actions and the resulting environmental harm. Particular attention is given to gaps in individual criminal liability for environmental crimes in the context of non-international armed conflicts, the absence of specialized institutional mechanisms for considering environmental claims, and the problems of information asymmetry and limited access to affected areas. Based on the research conducted, conclusions are drawn about the systemic nature of the identified problems, and potential avenues for improving the legal framework are outlined.
