Building Arbitration Infrastructure in Central Asia: The Institutional Landscape of Uzbekistan from ICAC to TIAC

This article examines the development of international commercial arbitration infrastructure in Uzbekistan, tracing the institutional evolution from the International Commercial Arbitration Court (ICAC), established in 2011, to the Tashkent International Arbitration Centre (TIAC), founded by Presidential Resolution in 2018. The article situates Uzbekistan’s experience within the global trend of arbitration institution-building in developing and transitioning economies, arguing that the ICAC-to-TIAC trajectory reflects both the characteristic challenges and emerging opportunities of constructing credible dispute resolution infrastructure in a post-Soviet context. Drawing on comparative institutional analysis, the article evaluates TIAC’s three successive rule sets (2019, 2021, and the TIAC-HKIAC Cross-Institutional Rules of 2022) against international benchmarks set by the ICC, LCIA, SIAC, and HKIAC. The article also analyses TIAC’s governance model – including its twenty-percent nationality cap on Court members – the pioneering cross-institutional cooperation with HKIAC, jurisdictional succession issues arising from the transfer of ICAC cases, and the quality-control challenges posed by the proliferation of 1,125 domestic arbitration institutions. The article concludes with an institutional development roadmap addressing awareness, judicial support, enforceability, and regulatory coherence.
