Annotatsiya

This article presents a detailed doctrinal and practice-oriented analysis of how International Humanitarian Law (IHL) protects prisoners of war (POWs) and novel categories of persons detained in contemporary conflicts. It identifies six systemic problems—status ambiguity; ICRC access and registration; accountability gaps for non-state actors; cyber operations; autonomous systems; and procedural guarantees—and examines recent practice from multiple theatres. The article offers granular proposals for treaty law, soft-law standards, and national implementation to close protection gaps.
