Some Issues of Criminal Misconduct in the Criminal Legislation of the Republic of Kazakhstan

Annotatsiya

This article examines current issues related to the implementation of criminal misdemeanors in Kazakhstan's legislation. The authors analyze the norms of existing criminal law, as well as provisions of the draft law that establish criminal liability for uncompleted criminal offenses. Taking into account the legislative experience of neighboring countries, the article substantiates the contradictory nature of introducing liability for preparation and attempt of criminal misdemeanors, as well as its inconsistency with the current criminal policy in the country. From the authors' perspective, a forecast of potential risks of social tension and other consequences is presented. Additionally, the article concludes that there is a need for consistent and comprehensive study of new provisions being introduced into the legislation.
