The article analyzes the scientific and theoretical foundations of the social need for criminal liability for smuggling, in particular, the expediency of dividing the opinions of legal scholars into four groups is substantiated. Four main factors that justify the public danger of smuggling and the public need for criminal liability for it are also identified.
