This article provides a comprehensive analysis of theoretical approaches to the nature of the mechanism of legal regulation governing compulsory insurance of a carrier’s civil liability for damage caused to passengers’ life, health, and property. In particular, the content, distinctive features, and scholarly significance of the instrumental, procedural, and integrative approaches to understanding this mechanism are examined from a comparative legal perspective. The article evaluates the advantages and limitations of these approaches and substantiates the priority of the instrumental approach, taking into account the legal nature of compulsory insurance relations. Furthermore, the structural elements of the legal regulation mechanism, their interrelationships, and their role in ensuring the effectiveness of the institution of compulsory insurance of a carrier’s civil liability are analyzed from a scholarly perspective. Based on the findings, theoretical conclusions and practical proposals aimed at improving the legal regulation mechanism in this field are put forward.
