The article provides a comparative analysis of the historical formation of the institution of fact-checking using the Avesta and the Code of Hammurabi as examples. The similarities and differences between the “water of oath gold” in the “Avesta” and the “water test” (ordalia) in the laws of Hammurabi are determined, and it is based on the fact that although their purpose is the same, their essence is different.
