This article provides a comparative legal analysis of the civil law status of human organ and tissue transplantation. It reveals the mechanisms of legal regulation of relations in the field of transplantation, protection of the rights of donors and recipients, as well as the features of organs and tissues as a special (sui generis) object of civil rights. The study analyzes international conventions and the legislation of developed countries, drawing conclusions on the interpretation of human rights within the framework of somatic rights, and develops proposals for improving the current legislation.
