The Legal Nature of Digital Assets: Challenges of Classification as an Object of Property Rights in Civil Law

Annotatsiya

This article examines the legal nature of digital assets in civil law and the challenges of classifying them as objects of property rights from the author’s professorial standpoint. A comparative analysis of the Russian Federation, the United Kingdom, Germany, China, and the UAE has been conducted. Article 81 of Uzbekistan’s Civil Code does not explicitly recognize digital assets as objects of civil rights. The study concludes with specific legislative proposals for incorporating digital assets into the Civil Code, establishing their property-law regime, and developing a dedicated legislative framework.
