This article provides a comprehensive analysis of the theoretical and practical aspects of jurisdiction in claims for compensation for damage to passengers and baggage in air transport. It focuses on the jurisdictional rules established by the Warsaw and Montreal Conventions and examines their application in the judicial practice of different countries. Particular attention is given to the divergent interpretations of key concepts such as “domicile”, “principal place of business”, and “place of contract”, which often lead to legal uncertainty. The study also explores pre-trial claims procedures and procedural challenges in determining the competent court. Special emphasis is placed on the “fifth jurisdiction” introduced by the Montreal Convention and its significance in enhancing passenger protection. Furthermore, the article addresses emerging issues related to digitalization and online contracting. The findings contribute to improving both international and domestic legal frameworks.
