This article analyzes the legal framework for explaining artificial intelligence system decisions in healthcare, focusing on the conflict between transparency requirements and the protection of developers' trade secrets. The research is relevant due to the rapid integration of AI systems into clinical practice and the development of corresponding regulatory frameworks at international and national levels. The study employs formal legal and comparative legal methods to examine legislation from the European Union, USA, and international standards governing AI-enabled medical devices. The findings show that existing legal instruments, including the EU Artificial Intelligence Act (AI Act) and the General Data Protection Regulation (GDPR), create a multi-tiered system of explainability requirements that potentially clashes with mechanisms for safeguarding trade secrets. The article concludes that a balanced approach is needed, one that considers the interests of patients, healthcare professionals, and technology developers.
