The article analyzes the recognition of the natural person as a subject of public international law, focusing on the criteria, levels, and limits of international legal personality. Doctrinal approaches—from complete denial to unconditional recognition—are systematized, and intermediate constructs of partial/mediated subjecthood are identified, including the concept of the “addressee (destinator)” of an international legal norm. It is shown that the evolution of international humanitarian, criminal, and human rights law, together with the institutionalization of judicial and quasi-judicial mechanisms (the ECtHR and UN treaty bodies), expands the individual’s procedural embeddedness while preserving systemic constraints of the classical interstate paradigm (including the jurisdictional barriers of the ICJ). Based on doctrinal-comparative and case-law analysis, operational criteria for individual access to transnational procedures are refined, and a multi-level model of international legal personality is proposed as a combination of legal capacity, capacity to act, and delict capacity (liability). The need is substantiated for codification updates and harmonization of international and domestic norms to balance states’ sovereign prerogatives with the individual’s participation in international legal relations; an applied framework is outlined for calibrating locus standi, responsibility mechanisms, and enforcement.
