The study examines the evolution and current state of the international legal personality of contested non-state actors—international non-governmental organizations, transnational corporations, and individuals—in the period following the establishment of the United Nations (from the 1950s to the present). The aim is to provide a systematic account of how these actors acquire and exercise derivative and functional entitlements within specific branches of international law, and to identify gaps in their capacity to incur international responsibility and in existing accountability mechanisms. The methodology combines doctrinal (black-letter) analysis of universal and regional treaties, the practice of international judicial and arbitral bodies, and doctrinal interpretation of soft-law instruments. The article’s originality lies in a holistic conceptualization of the “partial” (functional) international legal personality of non-state actors as a product of states’ institutional choices and the practice of international organs, with particular emphasis on distinguishing between substantive rights and procedural capacity and on the nexus between legal capacity and responsibility.
