Relevance: Special attention is paid to such important tasks as improving and liberalizing criminal and criminal-procedural legislation, increasing the efficiency and quality of justice, strengthening the procedural foundations of criminal proceedings, and ensuring reliable protection of the rights and freedoms of citizens in the activities of judicial and investigative bodies in the new Uzbekistan. The article outlines the study of international experience in ensuring the rights and freedoms of a person in criminal-procedural relations, criminal-legal institutions recognized in international law and foreign practice, including humanitarian principles in determining the criminal responsibility of a person, thus proposals and recommendations developed in this regard. Statement of the problem: The important issues such as the abdication of responsibility of an innocent person, ensuring the equality of parties at all stages of justice, reasonable application of procedural coercion measures, abandonment of the practice of torturing a person, cruel, inhumane or degrading treatment and punishment in the course of judicial investigation, full or partial release of a person from responsibility for sincere repentance and actively assistance in the detection of a crime, gaining the trust of citizens by compensating the property damage caused to the victims, as well as ensuring the rights and freedoms of the participants in the criminal proceedings were defined as the priority tasks of achieving justice in the New Uzbekistan. Aim of the research: The proposals and recommendations have been developed by the study, analysis, and research of the existing problems of ensuring the rights and freedoms of the individual in the proceeding of the case to court, to find scientific solutions to abdicate situations such as the violation of human dignity and honor, especially to terminate the practice of torture, cruel, inhuman or degrading treatment of a person, and the use of punishments. Methods of the research: general scientific, including formal logic (analysis, synthesis, generalization, abstraction, phrases), special scientific (observation, questioning, analysis of content of documents). Results and main conclusions: Studying the issues of ensuring the rights and freedoms of a person in proceeding the case to court, developing scientific recommendations for improving the mechanisms of researching the theoretical and legal foundations of ensuring the constitutional rights and freedoms of a person, and making a specific proposal for the further improvement of the norms of the criminal-procedural law to achieve a fair trial and promotion of recommendations remains one of the urgent issues of today. The desire to achieve justice for our people is increasing more and more in the era of globalization. The confidence of our citizens in justice and the rule of law is increasing as a result of the reforms implemented in the field. It can be said that along with the achieved progress, there are still important issues that are waiting to be resolved in terms of ensuring the rights and freedoms of the individual in the case before the court. The following issues remain one of the urgent tasks of today, such as ensuring transparency, strengthening the role of the institution of public participation in criminal cases. Moreover, to take all the necessary measures to restore the violated rights of individuals, to improve the activities of pre-investigation inspection and investigation bodies to ensure human rights, freedoms, and legal interests, to strengthen judicial control at the stage of bringing the case to trial, to liberalize the procedural order of criminal cases, to make judicial investigation activities transparent.
