Annotatsiya

This article examines the challenges associated with the application of Article XX of the General Agreement on Tariffs and Trade 1994 (GATT 1994) within the contemporary legal framework of the World Trade Organization (WTO). Particular attention is paid to the legal uncertainty arising from the interpretation and application of the introductory clause (chapeau) of Article XX, as well as the stringent criteria used to assess the “necessity” of measures adopted by WTO members, which may constrain their regulatory autonomy. The article analyzes the jurisprudence of WTO dispute settlement bodies and identifies the principal tensions between compliance with international trade obligations and the pursuit of environmental objectives. Furthermore, it explores potential avenues for improving the provisions of Article XX of GATT 1994 in light of contemporary global challenges.
