Annotatsiya

The article examines the formation and development of the idea of the rule of law in relation to the nature of law, the relationship between state and law, positive law and legal values, legality and legal validity. The rule of law is analysed not merely as a requirement that public authorities comply with legislation, but as a general legal idea expressing the subjection of public power to law, the conformity of positive legislation with certain legal qualities, and the regulatory and limiting role of law in relation to state power. The legal theories of Hans Kelsen, H.L.A. Hart, Lon L. Fuller, Joseph Raz, V.S. Nersesyants, S.S. Alekseev, Z.M. Islomov and Kh.T. Odilqoriyev are comparatively analysed. The study identifies major theoretical patterns in the evolution of the rule of law, including the transition from personal rule to normative governance, from law as an instrument created by the state to law as a limitation on state power, from formal legality to legal validity, and from an instrumental understanding of law to its recognition as a relatively autonomous social and legal value.
