States’ International Legal Obligations to Ensure the Right of Children with Disabilities to Inclusive Education and Their Implementation in National Law

This article analyzes Article 24 of the United Nations Convention on the Rights of Persons with Disabilities as a source of legally binding international obligations for States Parties and examines the implementation of these obligations in domestic law. Drawing on the rules of treaty interpretation established by the 1969 Vienna Convention on the Law of Treaties, the study determines the legal nature of the obligation to ensure inclusive education, distinguishes obligations requiring immediate implementation (non-discrimination and reasonable accommodation) from those subject to progressive realization, and assesses the legal significance of General Comment No. 4 of the Committee on the Rights of Persons with Disabilities. On this basis, the implementation practices of France and Uzbekistan are compared, and the role of international monitoring mechanisms (periodic reports, concluding observations, and individual communications) is examined. The study argues that incorporating an international treaty into domestic legislation does not, in itself, demonstrate that a state has fulfilled its treaty obligations. It proposes five recommendations aimed at bringing Uzbekistan’s legislation and legal practice into closer alignment with its obligations under the Convention.
