In the article, the author highlights some issues of criminal liability for crimes related to public procurement in some foreign countries. The article also analyzes some aspects characteristic of the responsibility of officials in the criminal legislation of some foreign countries for corruption crimes in the field of public procurement in the legislation of foreign countries. In addition, a comparative analysis of responsibility for the crime of concluding failed transactions in the interests of the state in connection with public procurement was carried out, scientific and theoretical views on the inclusion of the issue of liability of legal entities for crimes in the field of public procurement were discussed. In the criminal legislation of most foreign countries, it is noted that most of the crimes against the foundations of the economy committed by officials consist of crimes in which the interests of the state are indiscriminately concluded transactions, embezzlement and robbery, robberies using computer technology, fraud in the field of trade and services, and money laundering, obtained by criminal means. Crimes in the field of public procurement distinguish the following forms of corruption: direct participation of officials, civil service employees, deputies in commercial activities in order to see personal or corporate identity; using their official position to transfer public funds to commercial structures with the intention of appropriating them, etc.
