По опыту западных стран в некоторых случаях юристам разрешается и должно быть разрешено заключать сделки о признании вины, на которые их подзащитные не соглашались. Поскольку подзащитные несут на себе последствия обвинительного приговора, обычно доверители должны выбирать между заявлением о признании вины и возможностью оправдания в суде. Кроме того, доверители имеют право решить, что, хотя обвинительный приговор практически бесспорен, моральные или политические причины требуют настаивать на проведении судебного разбирательства. Традиционное понимание полномочий адвоката и доверителя по принятию решений привело бы к выводу, что последний имеет абсолютное право отклонить просьбу о признании вины, даже если это неизбежно ухудшит положение доверителя на его собственных условиях, увеличив срок тюремного заключения. В рамках данной статьи изучается опыт США, сравнивается правоприменительная практика с США и Республики Узбекистан, и вырабатывается вывод о наличии некоторых проблем в законодательстве Республики Узбекистан, а также о том, что выход адвоката за границы своих полномочий не допускается в Республике Узбекистан.
