Ensuring the rights of the individual in criminal proceedings is a very relevant topic of scientific research, in particular the components of this institute. One of the important elements of this institution is the right of appeal by participants in the criminal process and other persons against the actions and decisions of the bodies carrying out pre-trial and judicial proceedings in the framework of a criminal case. This article examines the right to appeal actions and decisions from the perspective of national and international law, in particular, the legislative and law enforcement practice of developed countries (Great Britain, USA, Canada, New Zealand, France, Germany, Italy), decisions of the European Court of Justice are studied. The norms of the International Covenant on Civil and Political Rights are analyzed and reflected in the national legislation of the country.
