The article provides a scientific and theoretical analysis of the concept and legal analysis of the detention of a person as a hostage as a terrorist crime. Analyzed the legislation of domestic and foreign countries on the detention of a person as a hostage, as well as the opinions of experts in the field of criminal law. Based on the results of the analysis, the article developed proposals to strengthen responsibility for the crime of taking hostages.
