Human trafficking is currently one of the most serious transnational crimes causing concern to the global community. This crime poses a particular danger as it is directed against human dignity, freedom, and inviolability. This article thoroughly analyzes the subjective aspect of human trafficking, namely the perpetrator's conscious actions, purpose, intent, and the characteristics of guilt formation. Additionally, it provides scientific-theoretical and practical substantiation that this crime can only be committed intentionally, with full awareness of guilt, and by exploiting the victim's vulnerable state. The article also compares existing legislative norms, international documents (especially the Palermo Protocol), and Article 135 of the Criminal Code of the Republic of Uzbekistan. In particular, it analyzes how the subjective aspect is assessed in examples from judicial practice. The conclusion offers recommendations on the importance of subjective factors in correctly qualifying the crime of human trafficking and improving the legal mechanisms for their identification.
