Issues of proportionality and sufficiency of measures of legal influence in criminal legislation

Annotatsiya

The author has studied the political and legal aspects of the application of the principle of proportionality in criminal law. The results of the analysis indicate the modernizing role of the constitutional principle of proportionality, which permeates the entire legal system from individual norms to entire institutions and branches, including criminal law. It has been established that the constitutional principle of proportionality obliges the legislator to distinguish between types of legal liability in order to: ensure a balance of the rights of the person brought to justice and the public interest; prevent excessive state coercion; prevent excessive state interference in the lives of citizens and society, which can be used as a standard for verifying the constitutionality of any state actions affecting human rights. In this regard, the author gives some proposals and recommendations for regulating this principle in criminal law.
