In this article, the author highlighted the analysis of the objective and subjective nature of the corpus delicti in the form of premeditated murder, which goes beyond the necessary measures to capture a person who committed a socially dangerous act, as well as their features. The author notes that the norms on causing harm during the detention of a person who has committed a crime apply equally to all persons, regardless of their professional or other special training and official status, to law enforcement officers and military personnel who participate in the suppression of socially dangerous encroachments in connection with their service duties or when caught. The article cites that the conditions for the legality of causing harm when detaining a person who has committed a crime are objective circumstances specified in the law, in the situation in which they exist, actions aimed at causing harm to a person who has committed a crime are legal. The author believes that the impossibility of catching a person who has committed a crime to transfer him to the authorities and prevent him from committing another crime should also be determined by the impossibility in this situation of catching and detaining a criminal without using violence, weapons, or special means against him.
