This article is devoted to the issues related to the qualification of crimes with a special subject, in which the special subject, which is a sign of the subject of the crime, and its signs are studied as one of the important signs of the crime in the qualification of the act. Also, a special subject who has committed a socially dangerous act provided for in the criminal law and law, if he has reached the age of criminal responsibility specified in this law, is sane, is considered the subject of the crime, as well as the scientific views and researches of scientists about him, the similarities between them and the different aspects are described in detail. At the same time, it is stated that in cases where there are no symptoms of a special subject, a slightly different situation occurs, in some cases, this crime means that it does not exist at all, while in other cases, criminal liability exists under other articles, that is, only the criminal-legal qualification changes. In the first case, for example, taking a bribe by a person who is not an official excludes criminal liability for this crime, because only an official can be the subject of this crime (Article 210 of the Criminal Code of the Republic of Uzbekistan). In the second case, the work of the institutions for the execution of the penalty of deprivation of liberty According to Part 2 of Article 220 of the Criminal Code, only extremely dangerous recidivists, persons convicted of serious or extremely serious crimes are criminally responsible, and other persons are held responsible for the aforementioned actions in accordance with Part 1 of Article 220 of the Criminal Code.
