In this article, the author highlights the specific aspects of the release of a person from punishment in connection with the loss of the nature of public danger in criminal law. The principle of inevitability of responsibility in criminal law does not always mean that criminal punishment should be applied to the person who committed the crime. In cases where a person or act has lost the nature of public danger, it is allowed to release him from punishment when considering a criminal case by a court. The basis for exemption from punishment for circumstances related to a person is an exemption from punishment in connection with the loss of a socially dangerous character by a person (Article 70 of the Criminal Code of the Russian Federation); release from punishment in connection with the sincere repentance of the perpetrator (Article 71 of the Criminal Code of the Russian Federation); conditional sentence (Article 72 of the Civil Code of the Russian Federation); parole before serving the sentence; (Article 73) replacement of punishment with a lighter one (Article 74 of the Criminal Code of the Russian Federation); including exemption from punishment due to illness or disability (Article 75 of the Civil Code of the Russian Federation). At the end of the article, the author made a proposal to amend the criminal law, providing for the release of a person from punishment in connection with the loss of his socially dangerous character.
